Change in bail conditions denied anew for sex abuse suspect

The Superior Court has denied again a motion to modify the bail conditions imposed on a 41-year-old man who is charged with sexually abusing a 12-year-old girl on Tinian since she was 8 or 9 years old.

In a written order issued Friday, associate judge David A. Wiseman said that one of the reasons why the court previously denied John Ibanez Carreon’s motion for bail modification was that the proposed third-party custodian lives on Tinian and the court will not allow Carreon to return to Tinian on pretrial release.

In the new motion to modify bail conditions, Carreon, through counsel, proposed as his third-party custodian a Tinian resident who resides on Saipan and attends the Northern Marianas College.

The proposed third-party custodian is 22, single, and presently staying with his parents at a Tinian guest house and plans to rent an apartment in Koblerville where Carreon will stay with him.

In denying the new motion, Wiseman said that, although the proposed third-party custodian was articulate and understood the role he was opting for, the court’s concern is the age disparity between Carreon and the proposed third-party custodian.

In addition, Wiseman noted, the apartment Carreon will be moving into has other apartments that may have minors living there.

“These two concerns resulted in the court finding the proposed third-party custodian unacceptable,” the judge said.

Wiseman pointed out that since the hearing on Feb. 19, the Office of the Attorney General filed more charges of sexual abuse of a minor in the first degree and additional counts of child abuse against Carreon.

Wiseman said the OAG also pointed out that the alleged victim in this matter almost killed herself as a result of the frequent alleged sexual molestations by Carreon.

The suspect, through the Office of Public Defender, wants the $50,000 cash bail reduced to $5,000 cash and $45,000 unsecured appearance bond. He proposes a third-party custodian.

Police arrested Carreon on Tinian last Jan. 25 after a concerned citizen reportedly called Tinian police two days earlier about a sexual abuse victim who wanted to die.
