Former attorney general Rexford C. Kosack will defend the wife of Public Auditor Michael Pai in a criminal case that charges her with stealing utility services amounting to over $51,000.

A source disclosed yesterday that Joanna C. Pai has hired Kosack to represent her in the case.

Kosack later confirmed this in a phone interview. “It’s confirmed. I’m representing Mrs. Pai,” he said.

Kosack said he will appear at Mrs. Pai’s arraignment on Monday at 9am in the Superior Court.

When asked for comments on behalf of Mrs. Pai about the charges, Kosack said he will do so on Monday.

The source said that Mrs. Pai will be filing a “very interesting” motion on Monday. When asked about this, Kosack only replied, “Check on Monday.”

Kosack also used to serve as chief prosecutor of the Office of the Attorney General’s Criminal Division.

The OAG had charged Mrs. Pai with one count of theft of utility services. Saipan Tribune learned from a source that the alleged theft involved Commonwealth Utilities Corp.’s power services.

The night before the filing of the case, a December 2010 Office of the Public Auditor investigation report was leaked by an anonymous source. The report concludes that Attorney General Edward T. Buckingham “violated criminal prohibitions” of both the Commonwealth Ethics Code Act and the Commonwealth Election Act when he hosted a campaign party for then delegate candidate Joseph N. Camacho on Aug. 28, 2010.
