Bench warrant issued for defendant in CDA lawsuit
A bench warrant was issued Thursday against a man for failing to appear at a scheduled hearing in the lawsuit filed against him by the Commonwealth Development Authority.
U.S. District Court for the NMI Chief Judge Ramona V. Manglona set defendant Herman C. Santos’ bail at $1,500.
CDA counsel Mark Scoggins asked the court to issue the bench warrant against Santos for not showing up at the hearing and for the court to order a payment plan.
Manglona denied CDA’s request for payment plan but issued the warrant.
Thursday’s show cause hearing was intended for Santos to explain why he should not be held in contempt for failing to make regular monthly payments as the court had earlier ordered.
Attorney F. Matthew Smith, co-counsel of Scoggins for CDA, said that the district court had entered a deficiency judgment against Santos, Ricardo C. Castro and Maria C. Castro on Jan. 10, 2006, in the amount of $7,191.45 plus interest at 9 percent per annum. Santos was ordered to pay $100 per month until the deficiency judgment is paid in full.
Smith said that Santos made his last payment of $100 on July 20, 2011.
