Sentencing of ex-detention guard delayed
U.S. District Court for the NMI Chief Judge Ramona V. Manglona granted yesterday the request of Tyron Farley Reyes Fitial’s lawyer to postpone his Sept. 13 sentencing in the case involving enticement of a female minor.
Manglona set the new sentencing date for Oct. 11 at 9am.
Fitial, a former detention guard at the Juvenile Detention Unit, pleaded guilty on April 19 to enticing a minor.
Attorney Joseph Norita Camacho, Fitial’s court appointed counsel, said the deadline for Fitial to submit any comments, corrections, or objections to the pre-sentence investigation report was set for today, Friday.
Camacho said his client has several concerns about the pre-sentence investigation report and that he needs more time to research the legal issues and prepare appropriate objections to the report.
Fitial’s original sentencing date was July 21, 2011. The court re-set the sentencing to Sept. 13 after the U.S. Probation asked for the delay in order to complete the pre-sentence investigation report.
Assistant U.S. attorney James Benedetto said that between October 2009 and February 2010, Fitial made telephone calls to a residence, during which one or more of these calls Fitial had a conversation of a sexual nature with a female 13 to 14 years old.
Benedetto said it was Fitial’s intent to get the girl to meet with him and that she indicated her willingness to meet him.
Fitial faces 11 criminal charges in the Superior Court over the same incidents.
