Man indicted for alleged production of child porn

A man was indicted in the U.S. district court on Monday after being allegedly found in possession of a cellular phone that had several images of children, including one image of a boy’s genitals.
The indictment charged 41-year-old Rogelio N. Dela Cruz with one count of production of child pornography. The indictment also sought to forfeit Dela Cruz’s cellular phone.
According to the indictment, between or about March 1, 2010 and March 18, 2011, Dela Cruz did “knowingly employ, use, persuade, induce, entice, and coerce” a minor boy to “engage in sexually explicit conduct for the purpose of producing a visual depiction of such conduct.”
The visual depiction, the indictment states, was produced “using materials that had been mailed, shipped, or transported in interstate and foreign commerce by any means, including by cellular phone.”
Federal agents arrested Dela Cruz on April 25 on charges of sexual exploitation of children and activities relating to material constituting or containing child exploitation.
Federal Bureau of Investigation special agent Haejun Park stated in his affidavit that police arrested Dela Cruz on Rota on March 18, 2011, for various charges related to possible sexual assault of a girl.
Park said the officer saw that Dela Cruz’s cell phone contained several images of young children and an image of a boy’s genitals.
The FBI obtained a federal warrant to search the defendant’s cell phone last April 20.
