DEQ cites firm over open dump
The Division of Environmental Quality has issued a notice of violation and cease and desist order against a private company for operating an open dump in violation of environmental law and regulations.
DEQ acting director David B. Rosario, in a Feb. 24 notice of violation, ordered United Construction Corp. to cease and desist all collection and storage of solid waste on site and to remove all solid waste from the site within 30 days after receipt of the notice.
Rosario said failure to comply with the notice of violation may result in the issuance of and administrative order and civil penalty.
DEQ is authorized to assess a maximum penalty of $25,000 per violation for each day of the continuance of the violation.
On Feb. 19, DEQ solid waste enforcement officer Gregorio Reyes conducted a solid waste compliance inspection at the UCC compound in Chalan Laulau.
The office observed that solid waste, including home appliances, household waste, cement bags, computer monitors, television, household waste, and junk vehicles had been disposed of at the site, but there was no evidence of solid waste burning.
DEQ said UCC’s ownership and/or operation of the open dump is in violation of the Solid Waste Management Act and the Solid Waste Management Regulations.
The division also ordered UCC to submit a final written notice to DEQ that all solid waste has been removed from the site, and provide receipt to DEQ showing proper disposal of the solid waste.
