Man gets seven days for hitting ex with lighted cigarette

The Superior Court imposed yesterday a seven-day prison term on a man who hit his former girlfriend in the back with a lighted cigarette.

Associate Judge David A. Wiseman sentenced Huiliang Gao to one year in prison, all suspended, except for seven days, for assault and battery.

Wiseman gave Gao credit for the days he had already served in jail. After completing the prison term, Gao will be placed on a two-year probation.

The judge ordered the defendant to write a letter of apology to the victim and required him to perform 200 hours of community service.

Wiseman ordered Gao to pay a $200 fine, $25 in court assessment fee, plus probation fee.

Gao was charged with three counts of assault and battery, and one count of disturbing the peace.

The defendant was accused of hitting his former girlfriend in the back with a lighted cigarette, kicking her on the leg, and punching her repeatedly in the head on July 11 and 17, 2007.

Gao entered a plea agreement with the government. He pleaded guilty to one count of assault and battery. The remaining charges were dismissed.

The factual basis of the plea agreement stated that on July 11, 2008, Gao unlawfully hit the victim in the back with a cigarette.
