Ex-convict gets 1-year term for attempted theft

The Superior Court has imposed a one-year prison sentence on an ex-convict who was convicted of attempting to steal a large air-conditioner unit at a factory last year.

Associate Judge David Wiseman sentenced Ivan T. Dela Cruz to two and a half years in prison, all suspended except for one year. Wiseman gave the 35-year-old Dela Cruz credit for 70 days he has already served in jail.

The judge placed the defendant on four years’ probation and required him to pay $4,000 in restitution to the American Textile Factory.

Dela Cruz was also ordered to pay a $100 fine and $100 court assessment fee and required to perform 300 hours of community service.

Dela Cruz was charged with one count of theft, two counts of criminal mischief, and one count of attempted theft for trying to steal the air-conditioner unit in October 2007.

The government also moved to revoke the defendant’s probation in previous case for not obeying CNMI laws.

The defendant signed a plea agreement and pleaded guilty to attempted theft. He also conceded to violating his probation.
