3 laborers sue for alleged labor law violations
Three laborers have filed a lawsuit in federal court against a recycling center for allegedly failing to pay them regular wages and overtime, as well as requiring them to pay processing fees.
Feiyi Tang, Anfeng Lin, and Anshun Lin sued Huang Zheng Corp. Ltd., operator of Recycling Center on Saipan, for violation of the Fair Labor Standards Act and breach of contract.
The plaintiffs asked the U.S. District Court for the NMI to order Huang Zheng Corp. to pay their unpaid regular time and overtime. They also demanded liquidated damages, interests, court costs, and attorney’s fees.
Huang Zheng Corp. operates the Recycling Center, which collects metals and other recyclable materials, packs such materials in a container and ships some to China.
Attorney Bruce Berline, lawyer for the plaintiffs, stated in the complaint that on Dec. 25, 2001, the defendant hired Tang and Anfeng Lin. On May 10, 2007 the company also hired Anshun Lin. Hired as laborers, the three were assigned to collect, sort, and pack recyclable materials.
Berline said the company fired both Anfeng Lin and Anshun Lin on Sept. 22, 2008.
The lawyer alleged that the workers were not properly compensated for their regular time and overtime in violation of the Fair Labor Standards Act.
He said the defendant breached the contract in that the company improperly fired Anfeng Lin and Anshun Lin and has failed to pay their regular time and overtime.
Berline added that the workers were also required to pay application fees related to the yearly renewal of their employment application/contract.
