2nd suspect in cable theft case gets 19-day jail term
The Superior Court yesterday imposed a 19-day prison term on the second of three persons accused of stealing telephone cables owned by the Pacific Telecommunications Inc.
Associate Judge Ramona V. Manglona sentenced the 32-year-old Erwin Evance to one year in jail, all suspended except for 19 days, for criminal mischief.
Following a plea agreement, Manglona gave Evance 19 days credit for the time he has already served in jail.
Evance was therefore released yesterday.
The judge placed the defendant on one-year probation and required him to pay jointly with co-defendants $481 in restitution.
Evance was ordered to pay a $100 fine and a $25 court assessment fee and perform 80 hours of community work service.
He was ordered to write a letter of apology to PTI and Saipan Mayor’s Office, through Mayor Juan T. Tudela and the general manager respectively.
The Attorney General’s Office charged Evance and Jesse S. Peredo with felony theft, conspiracy to commit theft, and criminal mischief.
A juvenile was also charged separately.
Peredo and the juvenile had also pleaded guilty.
Evance signed a plea agreement and pleaded guilty to criminal mischief.
According to the plea agreement, on June 14, 2007, Evance along with other persons caused damage to PTI’s telephone cables located at the Saipan Mayor’s Office.
