Plumeria firm sues tour agency

The managing company of the Plumeria Hotel has sued a tour agency for allegedly refusing to pay its outstanding balance to the company in the amount of $8,328.

Noah Saipan Inc., through counsel S. Joshua Berger, sued Sky Tour Agency for breach of contract.

Noah Saipan is the managing company on behalf of Saipan Achugao Resort Members Association, the majority owner of Plumeria Hotel.

The plaintiff asked the Superior Court to order Sky Tour Agency to pay the $8,328 principal amount, court costs, and pre-judgment interest.

Berger stated in the complaint that beginning in Dec. 2006, the defendant made numerous bookings and reservations for hotel rooms and other food services.

“As of October 2007, and taking into account some payments made, the defendant still has an outstanding balance of $8,328,” he said.

The lawyer said although Noah Saipan has made numerous attempts to settle the account, Sky Tour has remained unresponsive.

“Defendant is therefore in breach of its contract with plaintiff,” Berger added.
