Man in New Year’s Day beating gets 22-day sentence

Superior Court associate judge Perry B. Inos has imposed a 22-day prison term on a man who, along with a companion, beat up two men last New Year’s Day and kicked a pickup truck in another incident.
Inos sentenced Isai F. Roby to a year in prison, all suspended except for 22 days, for assault and battery, criminal mischief, and disturbing the peace. Roby was also sentenced to a year in prison, all suspended except for 10 days, for criminal mischief, in the second case.
The sentence in the second case shall be served concurrently with the sentence in the first case.
Inos gave the 26-year-old Roby credit for the 72 hours he has already served in jail. This means that Roby has 19 more days to serve in prison. He will start serving the rest of his sentence on Nov. 7, 2011.
After serving hi sentence, Roby will be placed on probation for three years. He was ordered to pay $1,736.82 in restitution in the beating case and $290 in restitution for damaging the truck.
Inos also required him to pay a $100 fine, $25 court assessment fee, plus probation fee, and perform 125 hours of community service.
Inos ordered Roby to complete anger management counseling and barred him from drinking any alcoholic beverages or using controlled substances during his probation.
In the beating case, the Office of the Attorney General had charged Roby with two counts of assault and battery, one count of criminal mischief, and four counts of disturbing the peace. For damaging a vehicle, the OAG charged the defendant with criminal mischief, and disturbing the peace.
Roby signed a plea agreement. He pleaded guilty to assault and battery, criminal mischief, and disturbing the peace in the beating case. He pleaded guilty to criminal mischief in the second case.
According to the plea agreement, Roby went to Jeanine Beauty Salon and assaulted Fortunato Roa Jr. on Jan. 1, 2011. The assault left Roa with facial cuts, swelling and bleeding. During this incident Roby damaged property in the salon.
On May 4, 2010, Roby kicked a gold 2001 Nissan Frontier pickup truck belonging to Soley Marie Kaipat. The kick caused a dent on the rear of the passenger door.
Detective Steven Castro stated in his report that Roby and Redson R. Herwin attended a party at the beauty salon and repeatedly punched Roa and Edison Duron.
