OPA affirms PSS decision on Rota school project bid
The Office of the Public Auditor sided with the Division of Procurement and Supply in its dispute with one of the bidders for a Rota school project.
Public Auditor Michael S. Sablan issued a decision Thursday affirming Procurement’s decision to deny the bid protest filed by DK Brothers in relation to the construction of additional classrooms at Rota Junior High School.
Sablan said that, contrary to DK Brothers’ allegation, the Procurement did not violate any laws or regulations by including the lowest bidder, Pacific Cooperation Limited, from the process.
The Department of Public Works bidded out classroom construction project earlier this year and received bids from three companies: Pacific Cooperation Limited, DK Brothers, and Radio Com, Saipan, Inc.
Pacific Cooperation was the lowest bidder, with a bid of $710,000.
On April 3, 2006, DK Brothers filed a protest with the Procurement director.
DK Brothers claimed that Pacific Cooperation had failed to fully comply with one of the bid requirements by failing to fill out the list of subcontractors and suppliers form. The company added that Pacific
Cooperation had failed to list the nature and scope of the work to be performed by the sub-contractors and suppliers for the construction project.
Four days later, Procurement denied the protest, finding that Pacific Cooperation did submit a list of intended material suppliers and did complete the “list of sub-contractors” for by writing “N/A”—not applicable—on it.
OPA agreed with the Procurement director.
