Co-worker of man pinned to death by car also sues driver

A co-worker of a construction worker who was pinned to death by a car in Chalan Kanoa also filed a lawsuit against the driver of the vehicle over his injuries.

Bonifacio Dimaunahan, through counsel Timothy H. Bellas, sued Hae Hung Jung for negligence.

Dimaunahan asked the Superior Court to order Jung pay him general damages for medical and incidental expenses, loss of earnings, attorney’s fees, and court costs.

Bellas said the collision was caused by the recklessness, carelessness, and negligence of Jung.

Bellas alleged, among other things, that the defendant operated the vehicle “at an excessive rate of speed under the circumstances then and there existing.”

The lawyer stated in the complaint that on April 25, 2006, Dimaunahan along with other construction workers was working on the drainage culvert that runs along the east side of Beach Road in Chalan Kanoa.

He said the workers were removing and replacing the damaged concrete covering on the three-foot deep drainage culvert.

The area was marked by three feet high orange warning posts as a construction site.

Bellas said at 11:50am, the defendant was driving her Toyota Camry north direction when the vehicle swerved into the wooden construction sign and into the site of warning markers.

Jung hit Dimaunahan with the car and propelled him 15 feet into the air and into the parking lot in front of Bank of Saipan, the lawyer said.

He said the car continued on and pinned Marcellano P. Garcia between the front of the car and the concrete edge of the drainage culvert. Garcia died.

Bellas said Dimaunahan was taken to the Commonwealth Health Center for treatment of injuries.
